Case summary

On December 8, 2014, Region 10 issued an administrative order on consent to James Conant (Respondent) to address Clean Water Act violations. Beginning in May 2013 and continuing through August 2013, Respondent violated the CWA Section 404 by discharging an unspecified quantity of dredged and/or fill material for the construction of an approximately 200 linear feet of new levee below the ordinary high water mark of Clear Creek without a Department of the Army CWA Section 404 permit. The consent order requires Respondent to submit a fill removal work plan to EPA for review and approval. Respondent is required to implement the EPA-approved plan and complete certain fill removal work by September 30, 2015. Respondent must submit a report to EPA upon completion of fill removal activities.
