Case summary

On December 23, 2013, EPA Region 10 issued this Stop Sale, Use, or Removal Order (SSURO) to Aldis Manufacturing, Ltd. to stop the further sale and distribution of “Kull 62 MUP” (EPA Reg. No. 9468-34) after it was imported into the US on or about October 26, 2013. The distribution or sale of this product is a violation of FIFRA because the product lacked the full Directions for Use and the Storage and Disposal instructions were not labeled in accordance with Title 40, Part 156.140 – 156.159 of the Code of Federal Regulations. Therefore the product was misbranded as defined by Section 2(q)(1)(F) of FIFRA, 7 U.S.C. § 136(q)(1)(F). Selling and distributing misbranded pesticides is a violation of Section 12(a)(1)(E) of FIFRA, 7 U.S.C. § 136j(a)(1)(E).
