Case summary
BASF Corporation (BASF) violated Section 12(a)(1)(E) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. § 136j(a)(1)(E), by selling and distributing a misbranded pesticide product. Information collected by the Idaho State Department of Agriculture (ISDA) during a December 29, 2009, inspection of Valley Agronomics, LLC (Valley Ag) showed that BASF, through Valley Ag, sold and distributed the pesticide product Outlook Herbicide (EPA Reg. No. 7969-156) with outdated labels. As the registrant of the product, BASF failed to provide the updated labels to Valley Ag in a timely manner and is ultimately responsible for the misbranded/outdated labels on the Outlook Herbicide products.
