Case summary

On November 9, 2012, EPA Region 10 issued a Consent Agreement and Final Order settling claims against Ferrell’s Fuel Network, Inc. for violations of Section 311(j) of the Clean Water Act, 33 U.S.C. § 1321(j), and accompanying Spill Prevention, Control and Countermeasures (SPCC) regulations, 40 C.F.R. Part 112. The violations were observed during a August 2011 inspection of the company’s oil storage and distribution facility in Klamath Falls, Oregon, and included failure to prepare and implement an adequate SPCC Plan for the facility. Ferrell’s Fuel Network, Inc. has agreed to pay of penalty of $28,200 to settle this matter.
