Case summary

Over a four-year period beginning in September 2009, Bill Case Farms undertook a series of unpermitted projects on his Albany, Oregon property that seriously harmed wetlands and riparian habitat on a large scale. The violations occurred at two locations along the North Santiam River. In addition to paying the $100,000 civil penalty, Bill Case Farms has agreed to perform the following restoration and mitigation work: ? Site Restoration ? Perform full restoration of the two sites (approximately 1845 linear feet of riverbank) damaged by Bill Case Farms? actions taken in 2009, 2012 and 2013. Work will include removal of the upstream and downstream revetment structures and, revegetation of the impacted areas. The agreement also includes five years of site monitoring. Additional restoration project - This restoration project will reconnect the downstream end of an oxbow on the South Santiam River and restore a native riparian forest to the existing farm field within the oxbow/farm field complex. Preservation through Restrictive Covenant: As part of the settlement, Bill Case Farms will place a restrictive covenant on approximately 50 acres of ecologically valuable land, including on the re vegetated oxbow/farm field complex.
