Case summary

Harms Pacific Transport, Inc. (Harms Pacific) has violated FIFRA Section 12(a)(2)(L) by producing pesticide in an unregistered establishments. The unregistered facility was located at 3220 North Glade Road in Pasco, Washington. The facility produced two pesticide products at their facility in 2009 without first being activated as pesticide producing establishment by the EPA. Harms Pacific violated FIFRA Section 12(a)(1)(E) by using the EPA Establishment number assigned to another company on the products they were producing. During 2009, Harms Pacific produced misbranded pesticides with the incorrect EPA establishment number on at least 15 different occasions. Harms Pacific also violated FIFRA Section 12(a)(2)(B)(i) by failing to maintain proper records under FIFRA. Harms Pacific is no longer producing pesticide products at their facility in Pasco, Washington. The EPA worked with Harms Pacific to ensure they understand the requirements of FIFRA if they decide to produce pesticides at any point in the future.
