Case summary

Granite Construction, Co. has agreed to pay a $735,000 cash penalty and to institute new internal programs to settle serious Clean Water Act violations that occurred at an Oregon highway construction site in 2006. That year, Granite caused sediment to be discharged to multiple water bodies along the construction corridor of Highway 20 for months, without authorization under Section 402 of the Clean Water Act. The Oregon Department of Environmental Quality has taken enforcement actions against both the Oregon DOT and Granite for lesser violations at the construction site but left it to EPA to enforce against the most egregious violations. EPA sought the monetary penalty, along with statewide injunctive relief that includes new stormwater training and compliance tracking measures, to settle the violations and to prevent a recurrence. Final consent decree entered on 2/27/2013.
