Case summary

On March 29, 2012, EPA Region 10 issued a Stop Sale, Use, or Removal Order to NPK Industries (NPK) in Medford, Oregon. On December 16, 2011, the Oregon Department of Agriculture forwarded to EPA, information about two products produced by NPK. EPA determined that, “Mighty Wash,” “PM Wash,” and “Power Wash” are unregistered pesticides; therefore, their sale and distribution is in violation of Section 12(a)(1)(A) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). This Section makes it unlawful to sell and distribute pesticides that are not registered under FIFRA. EPA is issuing this stop-sale in order to get this unregistered product out of the Marketplace and to bring the manufacturer into compliance.
