Case summary

The City of Culdesac, Idaho (City) has agreed to pay a $1,000 penalty to settle violations of the NPDES permit issued to the City for discharges from the City’s wastewater treatment facility. This enforcement action was resolved through an administrative consent agreement and final order pursuant to Clean Water Act section 309(g)(2)(B). The City’s wastewater treatment facility provides secondary treatment of wastewater prior to discharge into Lapwai Creek which flows into the Clearwater River. The wastewater treatment facility is part of a sanitary sewer system that receives domestic wastewater from residential and commercial sources. Between January 2007 and August 2011, the facility had 1,272 effluent limit violations of its NPDES permit. The facility exceeded its permit limits for Escherichia coli, biochemical oxygen demand, total suspended solids, total residual chlorine and pH.
