Case summary

On February 7, 2012, Region 10 filed a Consent Agreement and Final Order with Husch & Husch, Inc., and C.I. Lovell, Inc. (Lovell) to resolve violations of the Clean Air Act and EPA’s Federal Air Rules for Indian Reservations (FARR). Husch & Husch Inc., the property owner, hired Lovell to demolish a structure in Harrah, Washington. Neither party notified EPA prior to demolition, as required by the asbestos NESHAP, nor complied with the FARR requirements for limiting fugitive particulate matter emissions during demolition activities. Lovell also violated the FARR by burning demolition waste, a prohibited material. Both parties agreed to pay a total penalty of $11,000.
