Case summary
On June 19, 2013, Region 10 filed a Consent Agreement and Final Order that resolves violations of EPAs Federal Air Rules for Indian Reservations in Idaho, Oregon and Washington (a.k.a. FARR) by Empire Lumber Company (Empire) in Kamiah, Idaho, on the Nez Perce Reservation. Empire exceeded the visible emissions limit in the FARR at its planer cyclones on various dates from February to October 2009 and in September 2010. Empire agreed to pay a penalty of $70,000.
