EPA v. Stout Flying Service

Case summary

On April 21, 2011, the Tribal Pesticide Circuit Rider Program (Circuit Rider) responded to a pesticide drift complaint against Stout Flying Service. The drift incident occured in Culdesac, Idaho, which is located within the boundaries of the Nez Perce Reservation. The Circuit Rider inspector referred the inspection report to EPA for review and follow-up. EPA's investigation found that the pesticide applcation was in violation of Section 12(a)(2)(G) of FIFRA, 7 U.S.C. 136j(a)(2)(G). EPA has concluded the pesticides Orion (EPA Reg. No. 100-1307), and Tilt (EPA Reg. No. 100-617) were used in a manner inconsistent with their labeling by allowing the product to drift from the target site. Because of this, EPA has issued a civil penalty to Stout Flying Service
