Case summary
Formation Capital Corporation owns unpatented mineral claims within and adjacent to the Blackbird Mine Site. The US Forest Service has authorized FCC to construct and operate a cobalt, copper and gold mine. Road work and powerline work required to operate the mine will occur on the Blackbird Mine site. This work will modify existing remedial inftrastructure and could adversely impact the remedy. Other activities FCC undertakes may also affect the remedy. The AOC is necessary in order for EPA to review and approve plans for work that may affect the Blackbird Mine remedy.
