Case summary

On April 5, 2011, Region 10 filed a Consent Agreement and Final Order that resolves violations of EPA’s Federal Implementation Plans under the Clean Air Act for Indian Reservations in Idaho, Oregon and Washington (a.k.a. FARR) by Whitley Fuel, LLC, which owns and operates two fueling facilities located in Omak and Okanogan, Washington, on the Colville Indian Reservation. EPA alleged that Whitley Fuel, LLC failed to submit annual registration forms with the EPA from 2007 through 2009, as required in the FARR’s requirements for the registration of air pollution sources and the reporting of emissions. Whitley Fuel, LLC submitted all of the required information and agreed to pay a penalty of $3,750.
