Case summary

EPA has issued an Administrative Order on Consent to Clifford C. Walker, former owner of Whitestone Logging, Inc., that resolves alleged violations of the Clean Water Act. The violation occurred on Walker’s property near Hoonah, Alaska, and involved placement of approximately 3.000 cubic yards of fill material in 0.89 acre of wetlands adjacent to Game Creek and below the high tide line of Port Frederick, which are navigable waters of the United States, without a U.S. Army Corps of Engineers permit. The Consent Order requires compensatory mitigation for wetland impacts at a 2.5 to 1 replacement ratio by payment of an In-Lieu Fee to the Southeast Alaska Land Trust in the amount of $36,267.50. The In-Lieu Fee will be used to purchase similar wetlands offsite for preservation and to compensate for the impacts. Mr. Walker is also required to prepare for EPA review and approval a wetland Drainage Restoration Plan, which must include installation of three culverts in the fill road. The Consent Order replaces the Administrative Compliance Order that EPA issued to Mr. Walker in June 2009, which required removal of unauthorized fill material in wetlands and intertidal areas along with site restoration. The Consent Order will serve as a deterrent against future violations of the Clean Water Act by Mr. Walker and other land owners.
