On Dec. 10, 2010, Region 10 filed a Consent Agreement and Final Order against Misty Meadow Dairy in Tillamook, Oregon. During a January 2010 inspection, EPA Region 10 inspectors found that Misty Meadow Dairy was discharging manure-contaminated runoff from the Dry Cow Facility and other process waste water from the feed loading area, into Dougherty and Hoquarten Sloughs. EPA alleged that Misty Meadow discharged process waste water into Dougherty and Hoquarten Sloughs (which ultimately empty into Tillamook Bay), and that the discharge was not authorized by the NPDES general permit for CAFOs. Misty Meadow Dairy agreed to pay a penalty of $7,650.
