Case summary

On September 22, 2014, the United States and Lafarge North America, Inc. entered into a stipulation of judgment assessing a $300,000 civil penalty against the company for violations of its stormwater permit. The Lafarge facility is located on and discharges into the Lower Duwamish Waterway, a federal Superfund site for sediment contamination. As part of a large-scale effort to control sources of pollution to the Lower Duwamish Superfund Site, the Washington Department of Ecology and City of Seattle inspected the Lafarge facility on a number of occasions between 2006 and 2009, and documented recurring permit violations. In June 2009, the EPA joined Ecology and the City in an inspection of the Lafarge facility and noted multiple permit violations including noncompliance with discharge limitations and reporting and monitoring requirements, failure to property operate and maintain treatment systems, and noncompliance with the facility stormwater pollution prevention plan. The judicial stipulation with Lafarge was entered after the company implemented upgrades to the facility to reduce stormwater runoff to the Lower Duwamish Waterway, and requires the company to pay a penalty of $300,000.
