Case summary

Two investigations conducted by the Tribal Pesticide Circuit Rider Program (Circuit Rider) in 2006 and 2007 found that in June of 2006, Asplundh applied Dow AgroSciences Garlon 4 (EPA Reg. No. 62719-40) at a rate higher than the maximum allowable rate on its label on at least eight (8) occasions in Orofino and Sweetwater, Idaho. EPA’s review of the collected information found that Asplundh applied Garlon 4 at up to 11.76 times the maximum rate. Because of these misuses, EPA is issuing a civil penalty.
