In response to the tip, EPA requested that the Oregon Department of Agriculture (ODA) conduct an inspection of A-dec in Newberg, Oregon, which occurred on April 17, 2007. The product in question, ICX, is a dental waterline cleaner. ICX advertising, labeling, and the patent for ICX made claims about the antimicrobial efficacy of the product. A-dec began registering the product with EPA in 2006, which was granted on September 19, 2008. However, because A-dec sold ICX before EPA accepted the registration and product labeling, EPA issued the civil penalty.
