Case summary

On June 29, 2005, Swanson’s Pest Management, Inc., Eugene, Oregon, applied the pesticides CONQUER RESIDUAL PESTICIDE CONCENTRATE, EPA Reg. No. 1021-1641-57076, and ULD BP-100 CONTACT INSECTICIDE, EPA Reg. No. 499 -452 to two residences in on the Oregon Coast. Swanson’s illegally applied the products by 1) not ventilating the homes prior to the occupants reentering, 2) applying Conquer as a space spray, and 3) applying Conquer at nearly three time the allowable rate. Shortly after the owners of one residence returned to their home, they began to experience respiratory distress which resulted in the death of the women and the hospitalization of the man. Seven others, including paramedics, also because ill after entering the treated home.
