Case summary

This case concerns the information available to EPA indicates that on October 5, 2007 Emerald Recycling Services, Inc. received a shipment of 150 gallons oil from Silence, Inc., /TriGen LLC dba Midas Auto Service Experts (Midas) that was contaminated with polychlorinated bi-phenyls (PCBs) at a concentration of 93 parts per million (ppm). The PCB regulations at 40 CFR § 761.20(e) do not allow for the energy recovery of used oil containing PCBs at greater than 50 ppm. The PCB regulations further require such PCB- contaminated oil be properly marked and stored under 40 CFR §§ 761.40 and 761.65 respectively. The PCB-contaminated oil must also be properly manifested in accordance with 40 CFR § 761.208, and disposed of under 40 CFR § 761.60(a) at an incinerator.
