EPA v. WOODSTREAM CORPORATION

Case summary

Between May 10, 2008, and June 1, 2008, Woodstream imported more than 21,000 kgs of pesticide devices that were misbranded. EPA discovered the violative products during import inspections conduct at the port of entry (Ports America, Tacoma, WA) and a bonded warehouse (KPAC Tacoma Terminals, Tacoma, WA). EPA is issuing this action as a formal follow-up to the directions and conditions EPA imposed during the importation of the products. These conditions included 1) the misbranded product must be delivered to Woodstream’s EPA Registered Establishment (EPA Est. No. 47629-PA-001); 2) the false and misleading EPA establishment number (EPA Est. No. 47629-PA-001) on the product labeling must be removed or somehow superseded; 3) the false and misleading EPA establishment number (EPA Est. No. 47629-PA-001) on the shipping boxes in which the products are customarily distributed and sold to retailer stores must be removed and superseded with “EPA Est. No. 82253-CHN-001”; 4) proof of the correction must be provided to EPA; and, 5) the importer understands that EPA will place the products under a Stop Sale Order until proof is provided to EPA that they have been successful brought into compliance with FIFRA.
