Case summary

Wilco-Winfield LLC had been producing/repackaging at an unregistered facility in Mt. Angel, Oregon. This violation came to light when they purchased a production facility from another company that was delinquent with their reports. Wilco-Farmers submitted a 3540-16 for all facilities to ensure that all facilities that were currently producing were registered with EPA. The facility in Mt. Angel was producing under a number from a former facility of theirs that had been de-activated years ago. Additionally, they were not submitting annual production reports to EPA as required of all producing facilities. EPA has not negotiated an administrative penalty action of $1,950.00 per count for two counts of production of a pesticide in an unregistered facility and $1,547.60 per count for 6 counts of sale and distribution of a pesticide that is misbranded according to section 7.
