Case summary
On the week of March 31, 2008, Pinalpina Inc., the import broker for Lonza Ltd. (Lonza) submitted a Notice of Arrival of Pesticide and Devices (NOA) informing the U.S. EPA Region 10 (EPA) of Lonzas intent to import Meta Metaldehyde (EPA Reg. No. 6836-107). Included with the NOA was an outdated label for the product. On the week of April 7, 2008, EPA Region 9 contacted Region 10 about the Meta shipment. Region 9 also received a Notice of Arrival and contacted Lonza about an old label they submitted with the Notice of Arrival. Lonza stated that the old label was on the shipment. Therefore, EPA Region 10 decided to inspect the shipment on April 15, 2008. Our inspection confirmed the outdated label. Because of this, we have issued a Stop Sale, Use or Removal Order (SSURO) on the shipment. The SSURO formalizes that the product cannot be distributed in the United States as labeled and that Lonza has agreed to return the product to Switzerland.
