Case summary

EPA issued the Permit in 1994 and it expired on Mar. 31, 1999. Prior to expiration of the Permit, Washington Beef submitted a permit renewal application dated Sep. 29, 1998. They are operating on an administratively extended permit. On May 26, 2004, EPA inspected the facility and at the time of inspection the facility was discharging to Spencer Lateral through an unpermitted but proposed outfall. EPA received additional information on June 24, 2004, from Washington Beef, analysis of monitoring data showed that the discharges to Spencer Lateral were not permitted and parameters from the administratively extended permit were exceeded if the discharge was permitted. Subsequent NPDES reconnaissance of Spencer Lateral on Jan. 9, 2008, verified Washington Beef was still discharging what appeared to be untreated wastewater. It has determined that there are several violations based on both the administratively extended permit and the proposed permit. The violations range from discharging from an unpermitted outfall to exceedences of several permitted parameters including, pH, total suspended solids, oil and grease, flow, ammonia, and fecal coliform for Spencer Lateral based on both proposed parameters and permitted parameters.
