Case summary
On September 24, 2007, Agility Geologistics, the import broker for Suterra LLC. (Suterra) submitted a Notice of Arrival of Pesticide and Devices (EPA Form 3540-1) informing U.S. EPA Region 10 of Suterras intent to import 40 five kilogram containers (totaling approximately 200 kilograms) of Lavandulyl Senecioate. After reviewing the submitted documents, we discovered that the product was unregistered and was awaiting an approval for a Section 18 registration from California. After speaking with officials from EPA Region 9, the California Department of Pesticide Regulation, EPA Headquarters, and Suterra we have decided to issue this Stop Sale Order which outlines several conditions which Suterra must meet in order to import the product.
