Case summary

In 2002 and 2003, Dr. Jenkins cleared approximate 8 acres of a forested area and imported enough fill to the site to cover the surface up to 6 feet. A post fill delineation performed by Dr. Jenkin's consultant indicates that up to 2.33 acres of wetlands were impacted by the fill activity. On site restoration is not practicable as the property ownership has been sold to another party. The AOC requires the defendant to provide for off site mitigation on 20 acres of wetlands located within the same watershed by providing funding for the restoration and enhancement work to a local wetland land conservancy organization that owns and manages the 20 acre wetland.
