Case summary

On February 5, 2007, Expeditors, Import Broker for Aldis Manufacturing Ltd( Aldis)submitted a Notice of Arrival of Pesticide and Devices (EPA Form 3540-1) informing the US EPA Region 10 of Aldis's intent to import 95,400 kilograms (90, 1000 liter totes) of their recently registered pesticide Kull 62 MUP EPA Registration Number 9468-34. Following standard procedures for new pesticide imports, EPA Region 10 requested a copy of the EPA label attached to each of the 90 containers. Through several conversation with the broker and Aldis representatives, it was clear that the product was not appropriately labeled with the EPA accepted pesticide label. On February 13, 2007, on behalf of EPA Region 10l the Oregon Department of Agriculture inspected the shipmenht to verify the labeling accompanying the KULL 62 MUP containers. The inspection confirmed that the containers lacked the EPA accepted label and therefore are in violation of FIFRA.
