Case summary
Included with the report is a copy of a Uniform Hazaroud Waste Manifest number 02208. Acording to this manifest and other information obtained by EPA, the Cithy of Klamath Falls (Klamath) was the generator of 295 kilograms of PCB ballasts which were shipped for dispoal to VES on 8/16/20068. The documentation further shows the PCB ballasts were received by VES on 8/24/06. The out of service date for the PCB ballasts was 3/31/03, which is more than one year prior to the disposal of the ballasts at VES. According to 40 CFR Sec 761.65(a)(1), a generator has one year from the out of service date of a PCB ballast to dispose of the ballast. Klamath failed to abide by this requirement.
