Case summary

Respondent owns and operates a facility located at 21 West Sanderson Way in Shelton, Washington. In January of 2006 respondent shipped 30 kilograms of ballast containing PCBs from this facility for disposal at a chemical waste landfill in Arlington, Oregon. The out of service date for the PCB ballasts was 3/27/02. The failure to dispose of PCB ballasts within one year of the out of service date for this equipment is a violation of 40 CFR Sec 761.65. The manifest which accompanied the shipment of PCB ballasts did not contain a generator identification number of issued under TSCA. The failure to obtain a TSCA identification number prior to a shipment of PCB waste is a violation of 40 CFR Sec 761.202 EPA did not receive notification prior to the storage and shipmetn of the PCB ballasts. The failure to notify to EPA in advance of PCB waste handling activities is a violation of 40 CFR Sec 761.205.
