EPA v. LARRY BOYER LAND AND CATTLE

Case summary

In July of 2005, Boyer's application of Nufarm Credit Extra Systemic Herbicide (EPA Reg # 71368-20) and Amine 4 2,4-D Weed Killer (EPA Reg # 34702-120) to Bozarth-Middle and Crozier areas resulted in the off-site spraying of these presticides onto neighboring properties. Ther were desirable ornamental plants and vegetation on these properties which were impacted and damaged by the pesticides. EPA collected composite samples from the plants and vegetation which showed the presence of glyphosate (found in Nufarm Credit Extra Systemic Herbicide) and 2,4-D (found in AMINE 42,4-D Weed killer. In addition, photographs taken by EPA depict the vegetation and plant damage associated with an application of these pesticides. The labels for the presticides contain instructions prohibiting their application onto desirable ornamental plants and vegetation. EPA therefore alleges that Boyer misused these presticies, misused these pesticides, which is a violation of 12(a)(2)(G) of FIFRA.
