Case summary

The City of Seaside authorized Neawanna Cottages LLC to access the City's right of way to construct a sewer connection and a roadway. In January 2006, Neawanna Cottages LLC land cleared the area removing all vegetation and excavating a 100 ft. wide area. It also used the side cast material from the excavation to create an eight ft. high berm between the right of way and the adjacent high march wetland area located adjacent to the Neawanna Creek estuary. Approximately 0.6 acres were impacted by the violation.
