Case summary

Information obtained by EPA through inspections, review of import documents and the company indicate that Arch imported misbraded pesticides into the US on 13 separate occasions between June 2005 and January 2006. In June and July of 2005, Arch imported 9 shipments of their registered pesticide products Arch Technical ActiveTrichloro-s-triazintrione (EPA Reg No 1258-1258) and HTH Pace Dual Action 3 Chlorinating Tablets (EPA Reg No 1258-1244) in violation of Section 12(a)(1)(E) of FIFRA. The products were either missing the entire pesticide label or were missing important precautionary statements. After being notifed by the EPA via a July 14, 2005 Stop Sale Use or Removal Order, Arch stated that corrective action was taken to ensure future shipments complied with FIFRA. However, on 4 separate occasions in December of 2005 and January of 2006, Arch again imported the same misbraded products into the US. The company apologized for the later misbranded shipments and stated that their China based pesticide producing establishment had misunderstood their previous corrections on how to correct the labels. This penalty action is in follow up to EPA's Stop Sale Order.
