Case summary

Warrenton Wood Fiber Company (owned & operated by Martin Nygaard), has utilized the two tax lots involved to temporary dispose of wood waste material originating from their wood processing facility just down the road from these two parcels. One of these parcels was involved with an earlier EPA enforcement action in 1990 (Docket No. 1090-08-07-309) for the unauthorized placement of bark debris (fill) into wetlands. Partial restoration was required by EPA. However, in the expansion of their facility additional wood waste materials have been redeposited & spread out bark debris into wetlands & drainageways associated with Tansy Creek which runs along the west side of the properties. Tansy Creek is connected to the Columbia River, which drains into the Pacific Ocean. Compliance Order requires that a restoration plan be prepared & submitted for EPA approval that identifies fill removal areas & restoration activities proposed.
