Case summary
Maricopa discharged excavated material into a pond and wetlands during efforts to drain the pond. Maricopa subsequently discharged fill material into the pond for purposes of converting it to uplands. The unauthorized activities substantially lowered the water level of the pond and eliminated a portion of it and adjacent wetlands. Restoration Order will require reestablishment of a higher water level, removal of fill, and re-vegetation of disturbed areas.
