EPA Region 10 received an inspection report following a May 29, 2003 producer establishment inspection at Walla Walla Environmental, Inc (Walla Walla) conducted by Washington State Department of Agriculture (WSDA). The inspection was triggered by Walla Walla attempting to register its CPF-2D diazinon product with cancelled end uses with the State of Oregon. WSDA found an invoice showing the sale of the cancelled product to a Kelly Moore distribution center in San Carlos, CA. Communication with Kelly Moore, followed by receipt of photos of the received CPF-2D product and an affadavit, confirmed that Walla Walla sold the cancelled CPF-2D product violating FIFRA at 12a1A (selling an unregistered pesticide) and 12a2K (selling a cancelled pesticide).
