Case summary

On or about Aug. 1999, J. Clifford Cook, Jr., owner & operator of Lacamas Creek Enterprises Inc commenced mechanized filling of wetlands adjacent to Burnt Bridge Creek, in Clark County, WA. During this activity, Mr. Cook (Respondent) deposited stockpiled fill material into approx. 1.2 acres of wetlands. Mr. Cook proceeded with conducting the 1999 fill activity without obtaining a permit, even after being specifically instructed by the Corps to contact the Corps, if he planned to place fill on the site to determine if a permit would be needed. The property has been purchased by another company who is currently negotiating with EPA to restore the site.
