By this memorandum, the U.S. Environmental Protection Agency, Region 9 (EPA) is informing the Bureau of Customs and Border Protection of the U.S. Department of Homeland Security (CBP) that the following pesticide device import products in the shipment should be Denied Entry-Refused Delivery into the United States pursuant to the authority of Section 17(c) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. Section 136o(c), and the implementing regulations at 19 C.F.R. Section 12.114 and 12.117. The entry was marked Refused in the Automated Commercial Environment (ACE). On 6/17/2026 EPA and MSE Supplies LLC. settled for violations of the Federal Insecticide, Fungicide, and Rodenticide act involving the import of misbranded pesticide devices and failure to file a Notice of Arrival. MSE Supplies LLC. agreed to pay a penalty of $16,200. Under the conditions of the Expedited Settlement Agreement, the company was allowed to relabel the devices to bring them back into compliance and import into the US.
