Case summary
This Administrative Order on Consent (AOC) is entered into voluntarily by the United States Environmental Protection Agency (EPA) and Patricia Muniain (Respondent). This AOC is issued under the authority vested int he EPA Administrator by Section 309(a) of the Clean Water Act (CWA), 33 U.S.C. Section 1319(a), which provides that, whenever the EPA finds that any person is in violation of inter alia, Section 301(a) of the CWA, 33 U.S.C Section 311(a), the EPA may issue an order requiring such person to comply with the CWA, and shall specify a time for compliance that the EPA determines to be reasonable. This authority was delegated to EPA's Regional Administrators by Delegation 2-22 (May 11, 1994), and then further redelegated to the Director of the Enforcement and Compliance Assurance Division of the EPA, Region 09, by EPA Delegation R9-2-22 (February 11, 2013). Upon execution of this AOC, the EPA will immediately notify the State of California of this action pursuant to Section 309(a)(4) of the CWA, 33 U.S.C. Section 1319(a)(4).
