This Order is issued under the authority vested in the Administrator by Section 309(a) of the Clean Water Act (CWA), 33 U.S.C. Section1319(a), which provides that, whenever the EPA finds that any person is in violation of inter alia, any permit condition or limitation implementing any of such sections in a permit issued under Section 402 of the CWA, 33 U.S.C. Section 1342, the EPA may issue an order requiring such person to comply with the CWA, and shall specify a time for compliance that the EPA determines to be reasonable. This authority was delegated to Regional Administrators by delegation 2-22, dated May 11, 1994 (updated October 30, 2024). This authority was redelegated to the Director of the Enforcement and Compliance Assurance Division of the EPA, Region 9 by delegation R9-2-22 (February 11, 2013).
