Case summary

An Emergency Administrative Order (Order) issued by the United States Environmental Protection Agency, Region IX (EPA) under Section 1431 of the Safe Drinking Water Act (SDWA or Act), 42 U.S.C. Section 300i. EPA has determined that conditions exist at the Bodie Flats Marijuana Cultivation Site (Site) that may present an imminent and substantial endangerment to an underground source of drinking water (USDW) and to persons served by the Site's water system (System). EPA has made this determination based upon information in its possession that, among other concerns: (1) the System has cross-connections with unidentified chemical solutions that may contaminate the USDW and the System itself; and (2) the System is not properly maintained and at risk of pressure loss in the distribution system, which creates a high potential for contaminants or other disease-causing organisms to enter the drinking water system via backsiphonage.
