Case summary

On June 9, the importer, Tenerife International Trading, attempted to import a shipment of Air Purifier model DH-JH04 devices into the United States. The broker provided photos of the device packaging, and product literature. The product literature provided contains the term sterilization in reference to a UVC Light in the unit. A UVC light device cannot be labeled as sterilant or imply that it sterilizes. This statement is considered false and misleading and constitute a misbranding as that term is defined in Section 2(q)(1)(A) of FIFRA, 7 U.S.C. Section 136(q)(1)(A) and 40 CFR Section 156.10(a)(5).
