Case summary

The pesticide device?s label references the company?s website (https://dreamiracle.com). On the website, the Dreamiracle Model AP-3222 Air Purifier pesticide device contained the pesticide claim degerming which is misleading and also, contained graphics of virus molecules. If a label references a company?s website, either by listing a web address or URL, then the website becomes labeling under FIFRA and is subject to EPA review (PR Notice 2014-1). If the website contains false or misleading information, then the product may be considered misbranded and unlawful to sell or distribute under FIFRA 12(a)(1)(E). Additionally, under FIFRA section 2(q)(1)(D)a device is misbranded and subject to enforcement action if the label fails to bear the establishment number of the establishment where it was produced. The product?s label did not bear an EPA establishment number as required. Lastly, under FIFRA 12(a)(2)(N), the importer or the importer's agent did not file a Notice of Arrival of Pesticide and Devices (NOA), EPA Form 3540-1,prior to the arrival of the shipment in the U.S. or an electronic alternative to the NOA, filed with the entry documentation, via any U.S. Customs and Border Protection (CBP) authorized electronic data interchange system. All pesticide devices are required to be labeled in accordance with 40 C.F.R. Part 156, and any devices entering the United States cannot be misbranded (see Section 17 of FIFRA, 7 U.S.C. Section 136o(c)). The distribution of a misbranded pesticide device is an unlawful act under FIFRA Section 12(a)(1)(F), 7 U.S.C. Section 136j(a)(1)(F).
