Case summary
The Lessee agrees to undertake all actions required by the terms and conditions of this Settlement. One of the purposes of this Settlement is to resolve Lessee's potential CERCLA liability in accordance with the covenants not to sue, subject to the reservations and limitations. Another purpose of this Settlement Agreement is to release the United States windfall lien under CERCLA 107(r). The resolution of this potential liability, in exchange for Lessee?s payment of response costs and performance of the Work, is fair, reasonable, and in the public interest.
