Case summary
United States Environmental Protection Agency ( EPA ), has filed a complaint in this action concurrently with this Consent Decree, alleging that Defendant Kern Oil &Refining Co. ( Kern Oil or Defendant ) violated Section 111 of the Clean Air Act, 42 U.S.C. 7411, and Section 313 of Emergency Planning and Community Right-To-Know Act ( EPCRA ), 42 U.S.C. 11023, at its petroleum refinery located in Bakersfield, California ( Kern Oil Refinery ). The defendant hereby agrees that it shall be bound to perform duties expressly scheduled herein to occur on or after the date of lodging and prior to the effective date. Each undersigned representative of Defendant, SJVUAPCD, and the assistant Attorney General for the Environment and Natural Resources Division of the Department of Justice certifies that he or she is fully authorized to enter into the terms and conditions of this Consent Decree and to execute and legally bind the part he or she represents.
