The United States Environmental Protection Agency ( EPA ) and the Kauai Housing Development Corporation ( Respondent ) voluntarily enter into this Administrative Order on Consent ( Consent Order or AOC ). Respondent owns and/or operates fifteen Large Capacity Cesspools ( LCCs ) that serve the Hale Kupuna Elderly Housing Complex located at 2363 Puu Road, Kalaheo, Hawai'i 96741. EPA alleges that Respondent has violated and continues to violate requirements of the federal Safe Drinking Water Act (SDWA ). This Consent Order directs Respondent to remedy the ongoing violations relating to the continued ownership and/or operation of LCCs at the Hale Kupuna Elderly Housing Complex in accordance with the compliance schedule set forth in this Consent Order.
