Information collected during the inspections revealed that Univar USA Inc. failed to maintain a record of pesticide production for both, Liquichlor 12.5 percentage Solution, EPA Reg. No. 550-198, and Liquichtor 5.25 percentage Solution, EPA Reg. No. 550-199. Under Section 12(a)(2)(B) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. 136j(a)(2)(B), it is unlawful for any producer to refuse to prepare, maintain, or submit any records required by or under section 8 of FIFRA. Univar is advised to take all the necessary actions to assure that any further production of pesticides is made in full compliance with the provisions of FIFRA, including labeling and all required record-keeping and record maintenance. Failure to do so could subject Univar to civil administrative enforcement action.
