The U.S. Environmental Protection Agency, Region 9 (EPA) is informing the Bureau of Customs and Border Protection of the U.S. Department of Homeland Security (CBP) that the MosquitNo After Sun Insect Repellent in the import shipment described below should be Denied Entry-Refused Delivery into the United States pursuant to the authority of Section 17(c) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. Section 136o(c), and the implementing regulations at 19 C.F.R. Section 12.114. The parcel arrived without a Notice of Arrival. The importer, Charles W. Nicholas (Nicholas International), attempted to import a shipment of unregistered MosquitNo After Sun Insect Repellent into the United States. All pesticides are required to be registered with EPA before their entry into the United States, unless certain exemptions are met, pursuant to Section 3 of FIFRA (see Section 17 of FIFRA, 7 U.S.C. ? 136o(c)). The distribution of an unregistered pesticide, without an exemption, is an unlawful act under FIFRA Section 12(a)(1)(A), 7 U.S.C. ? 136j(a)(1)(A). The MosquitNo After Sun Insect Repellent imported by Charles W. Nicholas (Nicholas International), is not registered with EPA and does not meet any exemption for lawful entry. Therefore, this product cannot be allowed entry into the United States and should be denied pursuant to Section 17(c) of FIFRA 7 U.S.C.Section 136o(c).
