The U.S. Environmental Protection Agency, Region 9 (EPA) is informing the United States Customs and Border Protection of the U.S. Department of Homeland Security (CBP) that the Debug Tres (EPA Registration Number 70310-8) should be Denied Entry Refused Delivery into the United States, pursuant to Section 17(c) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. Section136o(c), and implementing regulations at 19 C.F.R. Section 12.114. An electronic alternative to the Notice of Arrival was filed in the Automated Commercial Environment (ACE) in accordance with 19 C.F.R. Section 12.112. The entry line pertaining to the Debug Tres was marked 'Refused' in ACE by EPA on October 10, 2019. The Notice of Arrival of Pesticides and Devices (EPA Form 3540-1) has been amended with an identical request. On September 27, 2019, an inspection of the shipment of Debug Tres was conducted at FCL Logistics, 1240 E. 230th St. Carson, California 90745. Based on information collected during the inspection and desktop reviews, EPA has determined the pesticides may not legally be imported into the United States.
