During an inspection conducted on January 30, 2020, EPA observed that the label of the export pesticides stated, Not registered in the United States of America. 40 CFR 168.70 requires that the label bears the statement, Not registered for use in the United States of America. The shipment did not meet the labeling requirements at 40 CFR 168.70 and the unregistered pesticide, is 'misbranded. The distribution of misbranded pesticide is an unlawful act under FIFRA Section 12(a)(1)(E) and the distribution of an unregistered pesticide is an unlawful act under FIFRA Section 12(a)(1)(A).
